Terms of Service
Please read these Terms of Service ("Terms") carefully before using Submitly. By creating an account or using the service you agree to be bound by them.
1. The Service
Submitly provides a hosted form-backend that accepts HTTP POST submissions on your behalf and stores them in your dashboard. You may configure email and SMS notifications to be sent when submissions arrive.
Submitly is a tool for website owners ("customers"). The individuals who fill in forms on your website are "end-users." You — not Submitly — are responsible for your relationship with your end-users.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use Submitly. By creating an account you represent that this is the case.
3. Your Account
- You are responsible for keeping your credentials secure.
- You must notify us immediately of any unauthorized access to your account.
- You may not share your account or allow others to use your endpoints on your behalf without taking responsibility for their actions.
- One person or legal entity may not operate multiple free accounts.
4. Acceptable Use
You agree not to use Submitly to:
- Collect data from individuals without their knowledge or lawful consent.
- Send spam, unsolicited commercial messages, or bulk communications via the notification feature.
- Transmit malware, viruses, or any code intended to damage or gain unauthorized access to systems.
- Facilitate phishing, fraud, identity theft, or any other illegal activity.
- Collect payment card numbers, government-issued ID numbers, passwords, or other sensitive credentials through Submitly endpoints.
- Violate any applicable law or regulation, including data-protection laws such as GDPR, CCPA, or CASL.
- Abuse the service in a way that causes disproportionate load or degrades performance for other customers (e.g. automated floods of submissions).
We reserve the right to suspend or terminate any endpoint or account that we determine — at our sole discretion — is in violation of these rules.
5. Your Content
"Your Content" means the form submission data, endpoint names, redirect URLs, and notification settings stored in your account.
- You retain ownership of Your Content.
- You grant Submitly a limited license to store, process, and transmit Your Content solely to provide the service to you.
- You are solely responsible for the legality of Your Content and for ensuring you have the right to collect the personal data your forms receive.
6. Privacy and Data Processing
Our Privacy Policy is incorporated into these Terms and explains how we handle personal data. By using Submitly you acknowledge and agree to the Privacy Policy.
7. Availability and Uptime
We strive for high availability but do not guarantee any specific uptime SLA on free accounts. The service is provided "as is" and "as available."
We may perform maintenance that temporarily interrupts the service. Where possible we will give advance notice via email.
8. Fees and Payment
Submitly is currently free to use. If we introduce paid plans in the future, we will give you at least 30 days' notice before charging your account. You will always have the option to downgrade or cancel before any charges apply.
9. Intellectual Property
The Submitly name, logo, and all software comprising the service are the exclusive property of Submitly and its licensors. These Terms do not grant you any right to use our trademarks or intellectual property other than as strictly necessary to access the service.
10. Disclaimers
To the fullest extent permitted by law:
- Submitly is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
- We are not responsible for the accuracy, completeness, or legality of submission data collected through your endpoints.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Submitly and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the service — even if advised of the possibility of such damages. In no event shall our total liability to you exceed the greater of (a) the amounts paid by you to Submitly in the 12 months preceding the claim or (b) $100 USD.
12. Indemnification
You agree to indemnify and hold harmless Submitly and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights, including privacy rights of your end-users.
13. Termination
You may delete your account at any time from your dashboard settings. Deletion is permanent; all Your Content will be removed within 30 days.
We may suspend or terminate your account immediately, without notice, if we determine you have violated these Terms, engaged in fraudulent activity, or pose a security risk to the service or other customers.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes your acceptance of the revised Terms. If you disagree with the changes, you may cancel your account before they take effect.
15. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction, unless prohibited by local law.
